Terms & Conditions

Welcome to Chough Rock. These Terms & Conditions explain how you may use our website and the terms that apply when purchasing products directly from us or through our online shop.

Chough Rock is an independent, Cornwall-based publisher creating children’s storybooks inspired by nature and wildlife. We also offer greeting cards, wildlife photography, prints and other nature-inspired products.

By using our website or placing an order with us, you agree to these Terms & Conditions. Please read them carefully before making a purchase.

1. About Chough Rock

Chough Rock is a family-run business founded by Martin and Zoë Yelland, specialising in children’s nature and wildlife books, greeting cards, wildlife photography and related products.

Business details

Chough Rock operates its own website and online shop. Some products may be purchased directly through our website, while others are available through our separate SumUp online shop.

Where purchases are made through SumUp, the relevant checkout, payment and order information will also apply. Unless the checkout identifies another seller, your purchase contract is with Chough Rock.

2. Using our website

You may browse and use our website for personal, non-commercial purposes.

You agree not to misuse the website, attempt to gain unauthorised access to its systems, interfere with its operation or use its content unlawfully.

We aim to keep the information on our website accurate and up to date, but we cannot guarantee that all content will always be complete, current or free from errors.

We reserve the right to update website content, products and prices where necessary.

3. Products and descriptions

We take care to describe and present our products as accurately as possible.

Our products may include:

  • Children’s storybooks and wildlife books.
  • Signed and personalised books.
  • Greeting cards and seasonal cards.
  • Hand-made decorations
  • Wildlife photography and photographic prints.
  • Clothing, gifts and other nature-inspired merchandise.

Product photographs and illustrations are intended to give a representative impression of each item. Colours, appearance and other details may vary slightly depending on screen settings, printing processes or product materials.

Some products may be made to order, personalised or produced in limited quantities. Any relevant product-specific information will be provided at the point of purchase.

Products are subject to availability, and we reserve the right to discontinue products or amend product descriptions where necessary.

4. Prices and payment

All prices will be displayed alongside the relevant products. Any applicable delivery charges will be shown before you complete your purchase.

Unless otherwise stated, prices are in pounds sterling (£).

Payment must be completed using the payment methods offered at checkout.

We accept orders through two sales channels:

Direct website orders: Payments will be processed using the payment facilities made available through our website.

SumUp online shop: Payments for products purchased through our SumUp shop are processed using the payment facilities provided by SumUp.

Payment processing may be subject to the relevant payment provider’s own terms and conditions.

We reserve the right to correct genuine pricing errors before accepting an order. If an error affects an order you have placed, we will contact you to discuss the available options.

5. Orders and order confirmation

When you place an order, you are making an offer to purchase the selected products.

An order confirmation acknowledges receipt of your order. Your order will be accepted in accordance with the confirmation and ordering process presented at checkout.

If we are unable to fulfil an order, for example because an item is unavailable or a pricing error has occurred, we will contact you and arrange a refund for any payment taken for the unfulfilled order.

Please check your order details carefully before completing your purchase. If you notice an error after ordering, contact us as soon as possible. We will do our best to help, although we cannot guarantee that changes can be made once an order has been processed or dispatched.

For orders placed through SumUp, please refer to the order confirmation and contact details provided with your purchase.

6. Personalised and signed books

We are happy to offer signed and personalised copies of selected books.

Where available, personalisation options will be explained on the relevant product page or agreed with you before the order is completed.

Please ensure that any names, spellings or personalisation details supplied are correct before submitting your order. We cannot accept responsibility for errors in personalisation where incorrect information has been provided by the customer.

As personalised products are made or prepared specifically for the individual customer, the statutory 14-day cancellation right for online purchases may not apply to goods made to the customer’s specifications or clearly personalised.

However, this does not affect your statutory rights if a personalised book is faulty, damaged or not as described.

If you have any concerns about a personalised order, please contact us as soon as possible.

7. Delivery and postage

We currently deliver to addresses within the United Kingdom only, however we may be able to offer International delivery upon request.

We aim to dispatch orders as promptly as possible. Unless another delivery period has been agreed with you, goods will be delivered within 30 days of the order being placed, as required by applicable consumer law.

Delivery times are estimates and may be affected by postal delays or circumstances beyond our control. If an order is significantly delayed, please contact us so that we can investigate.

Please ensure that your delivery address is correct when placing your order. We cannot guarantee successful delivery where incorrect or incomplete address details have been provided.

For orders placed through SumUp, please also refer to the delivery information provided during checkout.

8. Returns, cancellations and refunds

We want you to be happy with your purchase. If you have a problem with an order, please contact us at choughrock@gmail.com.

Your right to cancel

If you are a consumer purchasing goods online, you will generally have the right to cancel your order within 14 days of receiving the goods, without giving a reason.

To exercise this right, please notify us within the applicable cancellation period. You will then normally have a further 14 days to return the goods.

Where you cancel under these rules, we will refund the amount required by law, including the cost of standard delivery where applicable.

We may withhold reimbursement until we have received the goods back or you have provided evidence that they have been returned, whichever occurs first.

You may be responsible for the direct cost of returning unwanted goods where this has been made clear to you before purchase. You may also be liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Personalised products

The statutory right to cancel may not apply to goods made to your specifications or clearly personalised for you.

This exception does not remove your rights if a personalised item is faulty, damaged or not as described.

Faulty, damaged or incorrect items

If your order arrives damaged, faulty or incorrect, please contact us as soon as reasonably possible, providing your order details and photographs where helpful.

We will work with you to resolve the issue in accordance with your statutory consumer rights.

Depending on the circumstances, this may include a replacement, repair, refund or another appropriate remedy.

Nothing in these Terms & Conditions affects your legal rights as a consumer.

Returns for SumUp orders

If you purchased through our SumUp online shop, please contact us using the contact details provided with your order or the Chough Rock contact details above.

The same statutory consumer rights apply regardless of which of our sales channels you use.

9. Wildlife photography and photographic products

Chough Rock offers wildlife photography and related products celebrating the natural world.

Unless otherwise stated, all photographs remain the copyright of the original photographer or relevant rights holder.

Purchasing a photographic print or other photographic product does not transfer copyright or grant permission to reproduce, copy, distribute or commercially use the image.

Any permitted use of photographic content will be subject to the relevant licence or written permission from the copyright holder.

We take care to ensure that photographic products are accurately represented, although slight variations in colour, cropping and print appearance may occur depending on the printing process and display settings.

10. Copyright and intellectual property

Unless otherwise stated, all content on the Chough Rock website and in our publications, including text, stories, photographs, illustrations, artwork, graphics, logos and designs, is owned by Chough Rock or used with permission from the relevant rights holder.

Our content is protected by copyright and other intellectual property laws.

You may browse the website and share links to our pages for personal, non-commercial purposes.

You must not reproduce, copy, distribute, modify, publish, sell or commercially exploit our content without prior written permission from the relevant rights holder, except where permitted by law.

Purchasing a book, greeting card, photograph or other product does not transfer copyright or ownership of the intellectual property contained within it.

If you would like to use any of our photographs, illustrations, stories or other content, please contact us to discuss permission.

11. Links to other websites

Our website may contain links to third-party websites, including our SumUp online shop, payment providers and conservation organisations.

These links are provided for convenience or information. We do not control third-party websites and are not responsible for their content, availability, privacy practices or terms and conditions.

Any purchase made through a third-party platform may involve additional terms relating to the platform’s services and payment processing. Your statutory consumer rights remain unaffected.

12. Website availability and liability

We make reasonable efforts to keep our website available and functioning correctly. However, we cannot guarantee uninterrupted access or that the website will always be free from errors or technical issues.

Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.

In particular, nothing here limits your statutory consumer rights or our liability for matters that cannot legally be excluded or restricted.

To the extent permitted by law, we are not responsible for losses arising from your inability to access the website or from circumstances beyond our reasonable control.

13. Privacy and personal information

We respect your privacy and handle personal information in accordance with our Privacy Policy and applicable data protection legislation.

When you place an order, we use the information necessary to process your purchase, arrange delivery, communicate with you and meet our legal obligations.

Where a third-party platform processes your payment or order, its own privacy policy may also apply to the information it collects and processes.

Please read our Privacy Policy for further information about how we collect, use and protect personal information.

14. Changes to these Terms & Conditions

We may update these Terms & Conditions from time to time to reflect changes to our business, products, website or legal obligations.

The latest version will be published on this page, with the date of the most recent update shown at the top.

Any changes will not affect orders already accepted where doing so would be contrary to your legal rights.

15. Governing law

These Terms & Conditions are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the UK or overseas, you may also benefit from mandatory consumer protections under the laws that apply to you.

Nothing in these Terms & Conditions removes any rights that cannot lawfully be excluded.
